On Tuesday, September 27, 2011, the City Bar Center for CLE presented a panel discussion co-sponsored by The New York City Bar and the White Collar Criminal Law Committee discussing the substantive law of insider trading, with a particular focus on the new frontiers being explored in recent cases. Morvillo Abramowitz Partner Jodi Misher Peikin was Program Co-Chair of the panel, which included experts from government, industry, and law firms who focus on insider trading issues on a daily basis, and covered topics including: the core principles and elements of insider trading violations, including under Section 10(b), Section 14(e), and the mail and wire fraud statutes; the interplay of Reg FD and Rule 10b-5; the legitimacy of trading on information obtained from company insiders, including issues of materiality and the "mosaic" theory of investing; the legality of expert networking and channel checking; the line between civil and criminal insider trading violations; current and future DOJ and SEC investigative priorities.
