When is a doctor a doctor and when is a doctor an illegal drug dealer? In early March, the Supreme Court heard oral argument in two consolidated cases to address where that line is drawn. In our latest article for the New York Law Journal, “License to Pill — SCOTUS Confronts Doctors’ Good Faith Defense to Unlawful Distribution of Controlled Substances,” we discuss hints that this ruling may break from the Court’s recent pattern of relying almost entirely on textual analysis to narrow potential overbroad constructions of federal criminal statutes.
