Jonathan Sack Discusses US v. Caronia in Inside Counsel

Morvillo Abramowitz Partner Jonathan Sack was quoted in "2nd Circuit Decision Throws FDA's Drug Misbranding Cases Into Question" (February 2013 Issue Inside Counsel) which discusses the impacts of the landmark decision in US v. Caronia, a case concerning the off-label promotion of pharmaceuticals. Mr. Sack, speaking on the fallout from the decision, is quoted as saying: "Under Caronia, which held that speech that is truthful and not misleading is lawful and protected under the First Amendment, it means you could still have felony liability if the government can prove false or misleading speech."
